820/801 Domestic spousal Immigrant Visa Overview

The 820/801 Domestic spousal Immigrant visa is an application for an Australian permanent residence visa sponsored by an eligible sponsor, including an Australian citizen, permanent resident or eligible New Zealand citizen. The visa must be lodged in Australia and the applicant must be in Australia at the time the visa is issued. Normally, the applicant will be granted an 820 resident visa first, and after a 2-year relationship study period and meeting the corresponding conditions will be granted a 801 permanent residence visa. However, in some special circumstances, it is possible to obtain a permanent residence visa directly, such as the applicant has been married for more than 3 years at the time of the visa application, or the couple has children.

820/801 Domestic spouse immigrant Visa application requirements

Requirements for applicants: No education, work experience, proof of assets and other requirements for applicants, but applicants must meet health and character tests.

Sponsor requirements: Australian citizen, permanent resident or eligible New Zealand citizen over 18 years of age. Each person can only sponsor twice in their lifetime and at least five years apart, or more than five years if the sponsor obtained permanent residence status on a spousal visa (domestic spouse 820/801 or foreign spouse 390/100), or a contributing parent immigrant (subclass143), After the RRV visa transfer, you can sponsor your spouse to apply for immigration.

From 2021 onwards, spousal visa sponsors, who are permanent resident non-citizens, will be required to request an English language score of IELTS 4.5 or equivalent along with the applicant. Applicants must also pass a language test 12 months before applying.

The applicant must be the sponsor's married or common-law spouse (both heterosexual and same-sex), and the marriage and de facto marriage must have existed prior to the application.
